Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before accessing or using the Zenith mobile application, website, or any related services (collectively, the "Service") operated by Zenith Money LLC ("we," "us," or "our"). By creating an account, accessing, or using the Service in any manner, you ("you" or "User") agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
1. Acceptance of Terms
By downloading, installing, registering for, or otherwise accessing the Service, you represent that: (a) you are at least 18 years of age; (b) you have the legal capacity to enter into a binding contract; (c) you are not prohibited by any applicable law from using the Service; and (d) you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
Zenith is a personal financial trajectory simulation tool that provides illustrative, forward-looking projections of a user's potential financial path based on user-supplied inputs. The Service is designed to help users visualize the potential long-term effect of financial decisions on their projected net worth and work-optional age. The Service is not a bank, broker-dealer, investment adviser, financial planner, or licensed financial professional.
The Service includes:
- A mobile application for iOS and Android devices;
- A companion website accessible at zenithmoney.app;
- Optional account-linking features powered by third-party data aggregation services;
- Optional AI-generated narrative commentary on financial projections; and
- Subscription-based premium features.
IMPORTANT DISCLAIMER: All projections, estimates, and outputs generated by the Service are illustrative only and do not constitute financial advice, investment advice, tax advice, legal advice, or any other form of professional advice. Past performance is not indicative of future results. Projections are based on assumptions and simplifications that may not reflect your actual circumstances. You should consult a qualified financial, tax, or legal professional before making any financial decisions.
3. User Accounts and Registration
3.1 Account Creation
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your account credentials and for all activity that occurs under your account.
3.2 Account Security
You agree to notify us immediately at support@zenithmoney.app if you suspect any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.
3.3 One Account per User
Each user may maintain only one active account. Accounts are non-transferable and may not be shared with or sold to third parties.
3.4 Account Termination by User
You may delete your account at any time through the Settings menu within the application. Upon deletion, we will permanently purge your personal data in accordance with our Data Retention and Deletion Policy. Deleting your Zenith account does not cancel any active App Store or Google Play subscription; to stop billing, cancel the subscription through your Apple ID or Google Play account settings.
4. Subscriptions, Billing, and Payments
4.1 Free and Premium Tiers
The Service is offered on a freemium basis. Certain features are available at no charge (the "Free Tier"). Additional features are available through a paid subscription ("Zenith Plus" or "Plus").
4.2 Subscription Pricing
Current Zenith Plus subscription pricing is displayed at the point of purchase within the Service and is subject to change with at least 30 days' prior notice to existing subscribers. All prices are in U.S. dollars.
4.3 Free Trial
New subscribers are eligible for a 7-day free trial of Zenith Plus. You will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription at the then-current rate unless you cancel before the trial ends.
4.4 Billing and Renewal
Subscriptions are billed in advance on a monthly or annual basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel prior to the renewal date. Billing is processed through Apple App Store or Google Play Store, depending on your platform. You authorize the applicable platform to charge your payment method on file.
4.5 Cancellation
You may cancel your subscription at any time through your Apple ID or Google Play account settings. Cancellation will take effect at the end of the current billing period. No refunds or credits are issued for partial subscription periods, except as required by applicable law or at our sole discretion.
4.6 Refunds
All purchases are subject to the refund policies of the applicable app store platform. We do not control refund eligibility for purchases made through third-party app stores. For direct billing inquiries, contact us at support@zenithmoney.app.
5. User-Provided Data and Inputs
5.1 Accuracy of Data
The projections generated by the Service depend entirely on the accuracy and completeness of the information you provide. You acknowledge that inaccurate or incomplete inputs will produce inaccurate or misleading projections. You are solely responsible for the accuracy of the data you enter into the Service.
5.2 Optional Account Linking
The Service offers an optional feature to link your financial accounts through a third-party data aggregation service (currently, Plaid Inc.). Account linking is entirely voluntary and is available only to Zenith Plus subscribers. By using account linking, you authorize the applicable third-party provider to access your financial account data on your behalf and you agree to such provider's terms of service and privacy policy in addition to these Terms. We do not store your financial institution login credentials.
5.3 License to User Data
By using the Service, you grant Zenith Money LLC a limited, non-exclusive, royalty-free license to process, store, and display your User-provided data solely for the purpose of providing the Service to you. We do not sell your personal financial data to third parties. Please refer to our Privacy Policy for full details on data handling.
6. Artificial Intelligence Features
The Service may include AI-generated narrative content describing your financial projections, powered by the Anthropic Claude API ("AI Features"). AI-generated content is:
- Provided for illustrative and informational purposes only;
- Not reviewed, verified, or endorsed by a licensed financial professional;
- Based solely on the inputs and data you have provided to the Service;
- Subject to the limitations and inaccuracies inherent in large language model outputs; and
- Not intended as a substitute for professional financial, investment, tax, or legal advice.
You acknowledge that AI Features may occasionally produce outputs that are inaccurate, incomplete, or not suitable for your specific circumstances. Zenith Money LLC disclaims liability to the extent permitted by applicable law for any reliance on AI-generated content. AI Features are available to Zenith Plus subscribers only.
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its design, text, graphics, logos, icons, source code, software, and all other content (collectively, "Content"), is the exclusive property of Zenith Money LLC or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for your personal, non-commercial purposes in accordance with these Terms.
7.2 Restrictions
You agree not to:
- Copy, modify, distribute, sell, lease, or sublicense any part of the Service;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service;
- Use the Service to create a competing product or service;
- Remove, alter, or obscure any proprietary notices or labels on the Service; or
- Use automated tools, bots, scrapers, or data-mining techniques to access the Service.
7.3 Feedback
If you submit ideas, suggestions, or feedback regarding the Service ("Feedback"), you grant Zenith Money LLC a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, and incorporate such Feedback into the Service without any obligation or compensation to you.
8. Prohibited Conduct
You agree not to use the Service to:
- Violate any applicable local, state, federal, or international law or regulation;
- Impersonate any person or entity or falsely state or misrepresent your affiliation;
- Transmit any unsolicited or unauthorized advertising or promotional material;
- Introduce viruses, trojans, worms, or other malicious code;
- Attempt to gain unauthorized access to the Service, its servers, or any connected databases or systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Circumvent any security measures or access controls implemented by the Service; or
- Use the Service for any fraudulent, deceptive, or harmful purpose.
We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section, including removing offending content, suspending or terminating accounts, and reporting such activity to law enforcement.
9. Third-Party Services and Links
The Service integrates with and may contain links to third-party services, websites, and applications, including but not limited to:
- Apple App Store and Google Play Store (distribution and billing);
- Supabase Inc. (authentication and data storage);
- Plaid Inc. (optional financial account aggregation);
- RevenueCat Inc. (subscription management);
- OneSignal Inc. (push notification delivery);
- PostHog Inc. (product analytics);
- Functional Software, Inc. d/b/a Sentry (error monitoring); and
- Anthropic PBC (AI narrative generation).
Zenith Money LLC does not control, endorse, or assume responsibility for any third-party services, and your use of such services is governed by their respective terms and privacy policies. We encourage you to review the terms and policies of any third-party services you use in connection with the Service.
10. Disclaimers of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZENITH MONEY LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; WARRANTIES THAT THE PROJECTIONS, ESTIMATES, OR OTHER OUTPUTS PROVIDED BY THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPLETE; AND WARRANTIES OF ANY RESULTS OR OUTCOMES THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE.
ZENITH IS NOT A REGISTERED INVESTMENT ADVISER, BROKER-DEALER, FINANCIAL PLANNER, OR FINANCIAL ADVISER. NOTHING IN THE SERVICE CONSTITUTES FINANCIAL ADVICE, INVESTMENT ADVICE, TAX ADVICE, LEGAL ADVICE, OR ANY OTHER FORM OF ADVICE. ALL PROJECTIONS AND OUTPUTS ARE ILLUSTRATIVE ONLY AND SHOULD NOT BE RELIED UPON AS A BASIS FOR ANY FINANCIAL DECISION.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZENITH MONEY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, INVESTMENT LOSSES, OR ANY OTHER FINANCIAL LOSS; EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO ZENITH MONEY LLC FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
12. Privacy
Your privacy is important to us. Our Privacy Policy, available at zenithmoney.app/privacy and within the application, describes how we collect, use, and share information about you when you use the Service. By using the Service, you agree to the collection and use of your information in accordance with our Privacy Policy. Our Privacy Policy is incorporated into and forms part of these Terms.
13. Modifications to the Service and Terms
13.1 Changes to the Service
Zenith Money LLC reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, at our sole discretion. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
13.2 Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email (to the address associated with your account), by an in-app notification, or by updating the "Effective Date" at the top of these Terms. Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict-of-law principles.
14.2 Informal Resolution
Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute informally by contacting us at support@zenithmoney.app. We will make a good-faith effort to resolve the dispute within 30 days of receiving your notice.
14.3 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are incorporated herein by reference. The arbitration shall be conducted in the English language. The seat of arbitration shall be in the State of Wyoming. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Mass Arbitration Protocol: If 25 or more claimants submit demands for arbitration raising substantially similar claims against Zenith Money LLC within a 180-day period, the parties agree that AAA's Multiple Case Filing procedures shall govern, and the parties shall cooperate to consolidate, batch, or otherwise streamline such proceedings to the extent permitted by applicable rules. Any applicable filing fees shall be determined in accordance with the AAA's then-current Multiple Case Filing Fee Schedule.
14.4 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST ZENITH MONEY LLC. YOU MAY BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Notwithstanding the foregoing, either party may seek public injunctive relief in a court of competent jurisdiction as permitted under applicable law, and no arbitral forum shall have authority to award public injunctive relief.
14.5 Exceptions
Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction in the State of Wyoming to prevent irreparable harm pending the outcome of arbitration.
15. Children's Privacy
The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If you are under 18, you must not use or attempt to register for the Service. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete that information as soon as reasonably practicable. If you believe a child under 18 has provided us with personal information, please contact us at support@zenithmoney.app.
16. Termination
Zenith Money LLC may, in its sole discretion, suspend or terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. Causes for termination include, without limitation, violation of these Terms, fraudulent or illegal activity, or extended account inactivity.
Upon termination: (a) all rights and licenses granted to you under these Terms will immediately cease; (b) you must cease all use of the Service; and (c) sections of these Terms that by their nature should survive termination shall survive, including without limitation Sections 7, 10, 11, 14, and 17.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Zenith Money LLC with respect to the Service and supersede all prior and contemporaneous understandings and agreements.
17.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms will remain in full force and effect.
17.3 Waiver
No failure or delay by Zenith Money LLC in exercising any right under these Terms will constitute a waiver of that right.
17.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Zenith Money LLC may freely assign these Terms, including in connection with a merger, acquisition, or sale of all or substantially all of its assets.
17.5 Force Majeure
Zenith Money LLC shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, epidemic or pandemic, war, terrorism, labor disputes, governmental actions, or failure of third-party infrastructure.
17.6 No Professional Relationship
Nothing in these Terms creates any agency, partnership, joint venture, employment, or fiduciary relationship between you and Zenith Money LLC.
17.7 Electronic Communications
By using the Service, you consent to receive communications from us electronically, including by email or in-app notification, and you agree that all communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
17.8 Formal Notice
All formal legal notices to Zenith Money LLC must be delivered by certified mail, return receipt requested, to: Zenith Money LLC, 30 N Gould St, Ste N, Sheridan, WY 82801, with a concurrent copy by email to support@zenithmoney.app. Notices to Zenith Money LLC are effective upon receipt by certified mail. Zenith Money LLC may deliver notices to you by email to the address associated with your account or by in-app notification, which shall be effective upon transmission.
17.9 Copyright Infringement (DMCA)
Zenith Money LLC respects intellectual property rights and expects users to do the same. If you believe that content available through the Service infringes your copyright, please send a written notice containing the information required by 17 U.S.C. § 512(c)(3) to our Designated Copyright Agent at: support@zenithmoney.app (Subject: "DMCA Notice") or by certified mail to: Zenith Money LLC, Attn: Copyright Agent, 30 N Gould St, Ste N, Sheridan, WY 82801. Counter-notices and repeat-infringer termination are handled in accordance with the DMCA.
17.10 Regulatory Change
If a material change in applicable law or regulatory guidance imposes new obligations on either party with respect to the Service, the parties agree to negotiate in good faith to modify the relevant provisions of these Terms as necessary to comply with such requirements, without prejudice to either party's rights in the interim.
17.11 Data Breach Notification
In the event of a security incident involving unauthorized acquisition of personal information that triggers notification obligations under applicable law, Zenith Money LLC will provide notification to affected individuals in accordance with those obligations, including, to the extent applicable, Wyoming's data security breach statute (Wyo. Stat. § 40-12-501 et seq.) and any other applicable state or federal breach-notification requirements. Notification will be provided in the most expedient time possible and without unreasonable delay consistent with any legitimate needs of law enforcement and any measures necessary to determine the scope of the incident and restore the integrity of affected systems.
17.12 Export Controls
The Service and any related software or technology may be subject to U.S. export-control laws and regulations, including the Export Administration Regulations ("EAR") and the sanctions programs administered by the Office of Foreign Assets Control ("OFAC"). You represent and warrant that: (a) you are not located in, or a national or resident of, any country to which the United States has embargoed goods or services; and (b) you are not, and are not acting on behalf of, any person or entity that is listed on any U.S. government restricted-party list, including the Treasury Department's list of Specially Designated Nationals or the Commerce Department's Denied Persons List. You agree to comply with all applicable export-control laws in connection with your use of the Service.
